VENDOR APPLICATION AND AGREEMENT

Flea Country USA welcomes your interest in becoming a vendor. Flea Country USA intends to maintain a clean, family oriented, attractive market, favorable to your financial success. The following rules are meant to benefit every vendor and contribute to the success of the market as a whole and may be amended.

1. Market Hours of Operation: Saturday 8:00 am to 5:00 pm

Sunday 9:00 am to 5:00 pm

• Vendors will be admitted at the vendor’s entrance in the rear of the building at 7:30 am on market days.
• Vendors are required to open promptly at 8:00 AM on Saturday and 9:00 AM on Sunday and remain open until 5:00 pm. If it is not possible for the vendor to cover his or her booth due to illness or unforeseen circumstances, please notify the management and we will post a temporary sign on your booth.
• No moving in or out during business hours.
• Any vendor not open for business by 10:00 AM on Saturday and 1:00 PM on Sunday and has failed to post a sign on there booth and/or notify management of Flea Country will be charged $ 10.00 per occurrence.
• Management reserves the right to open the market for extra days during special holidays or events.
• If you attend church and know that you will not be at the market until 12:30 post a sign on your booth.
• The market will be open to vendors ONLY on Friday 9AM-6 PM lunch 12-1, Monday 9-5 lunch 12-1 and Tuesday from 9-12 PM.
1. Space Rental:
• Basic rental rate standard 10 x 10 $ 17.50 / day $ 35.00 / weekend
• Rental Period (4 weeks) standard 10 x 10 $ 140.00 – 10% = $ 126.00
• End Cap add 8.75 per booth
• All rents shall be paid in advance before setting up. Recurring rents shall always be paid in advance for every rental period by the close of business on the Sunday proceeding the rental period.
• There are NO REFUNDS for any rent.
• Vendors’ rent that is not paid by the close of business on the Sunday preceding the rental period will not be allowed to open for the next market day until the rent is paid and will incur a $10.00 per market day service fee.
• Vendor will be deemed in default of this agreement if the rents and service fees are not paid prior to opening for business as described above and the space will therefore be forfeited. Product remaining in said space shall be considered abandoned and will be removed by management to a storage area and if rents and storage fees are not paid the merchandise becomes the property of Flea Country USA and will be liquidated toward the satisfaction of accumulated rents and fees.
• Flea Country USA reserves the right to rent a space or extend any rental period, and to assign or re-assign any space in order to accommodate an expansion or most efficient use of space.
• Management on request will price special size booths including outside space.
• Subleasing of spaces is not permitted.

3. Rent Payment Policy:
• Rent is payable by cash, check (no two party checks), credit or debit card. A receipt is issued for every payment. Payment method will be noted on the receipt..
• Returned checks will incur a $ 25.00 service fee. With a history of returned checks you will not be able to pay rent with checks only cash, certified funds, credit or debit card.
• No announcements will be made over the PA system to remind you “to pay your rent.”
4. Licenses:
• Flea Country USA is located in Forsyth County in the City of Winston-Salem North Carolina. Flea Country USA holds a master business license for the entire market. Your license is included in your rent.
5. Taxes:
• Every vendor is responsible for obtaining a state sales tax number from the North Carolina Department of Revenue at 8025 North Point Blvd. Winston-Salem, NC 27106 or phone (336) 896-7024. Each vendor must pay the 7.5% state sales tax directly to the state in accordance with N. C. State law.
6. Insurance:
• Flea Country USA assumes no responsibility for any physical loss or damage at any time to the physical property or inventory of any vendor. Flea Country USA is under no obligation to provide theft insurance, casualty insurance, fire insurance, general liability insurance, or mischief insurance for the personal or business property of any vendor or any claims for personal injury, death, or property damage in or about the spaces rented by any vendor.
• Each vendor will indemnify and hold Flea Country USA harmless from any loss, cost, or expense of any sort or nature, including reasonable attorney fees and costs; and will indemnify and hold Flea Country USA harmless for any liability to any reason on account of any damage to persons or property resulting or occurring by reason of the use and occupancy of a space by vendor, or for any failure of a vendor to comply in any respect with; or to perform any of the requirements and provisions of the rules and regulations or State and City Ordinances.
• Check with your insurance provider to see if a rider may be attached to your Home Owners insurance policy to cover your property located at Flea Country USA.
7. Vendor Space and Product
• Vendors’ merchandise and display must remain within the rented booth space and not protrude into the aisles.
• Solicitation outside the rented space, on the sidewalk or in the parking lot is not permitted.
• All products or services offered from your space must be legal in this jurisdiction.
• Objectionable product or conduct as determined by the management will result in immediate removal from the premises.
• Sound amplification must be kept at a reasonable level that does not disturb any neighboring vendor.
• The burning of incense is permitted but limited to one piece. Complaints from neighboring vendors will result in this product not being allowed to be burnt.
• Vending machines are allowed for a $ 5.00 per weekend up charge each, prior approval required, if electrical, extra charges will be assessed.
• No food, beverages, candy or any consumables may be sold on the premises without management’s written permission and approval from the health department. This applies to both prepackaged and homemade food products.
• If you bring children to the market they must be supervised by an adult at all times.

8. Booth Construction
• Patrician structures which the vendor may wish to construct must be no higher than eight (8) feet tall and must be constructed with design and materials approved by management.
• No temporary structures will be permitted.
• Lattice, metal grid, 2x4 stud walls, slate wall, no tarps.
9. Trash & Boxes:
• Boxes must be broken down and placed in the dumpster.
• Trash barrels are located throughout the market are for disposal; of trash from the public.
• Every vendor is responsible to take their trash to the dumpster.
• Each vendor is responsible for sweeping and keeping their booth clean.
10. Abandonment of Property:
• Any inventory, fixtures, or building material left anywhere on the Flea Country USA property shall become the property of Flea Country USA and will be sold, removed, or destroyed. All proceeds from a sale of any of the above shall benefit Flea Country USA. Any of the above not sold, removed, or destroyed will be subject to a storage fee equal to daily space rental. The above also applies to any vendor that has checked out, been evicted, or has vacated the space.
11. Electricity:
• Is available for a fee of $ 4.00 per weekend per space for basic service (cash register, one or two lighted show cases and credit card machines).
• If you need additional electricity consult management for the charge.
• Special electrical needs or drops require an electrician at your expense.
• Electric strips must be grounded type with a circuit breaker and shall not exceed six feet in length.
• Electricity is not available to all spaces.
• No Extension cords are permitted.
12. Heaters:
• None permitted
13. Storage:
• Storage is available on the upper mezzanine in 10 x 10 spaces for $ 40.00 per month.
• Rental must be paid in advance.
• Flea Country USA assumes no responsible for this area or your property.
14. Exclusive on Merchandise
• No exclusives may be granted or extended to any vendor (except food). We will make every effort to assure that a vendor selling like merchandise; will not be located in the same proximity to one another.
15. Gift Certificate Give-away
• Gift certificates will be awarded to registering customers (through drawings to be determined) in the amount of $20.00 to be honored by any vendor that it is presented to. The vendor will then apply the gift certificate toward their rent, less a $ 2.00 charge.
16. Website www.fleacountry.com
• Each vendor will be listed on our website (optional) at no charge. You will need to provide us with your company name, items to be sold, links to your website, etc.
17. Handouts
• Available at the office for your distribution at convenience stores, laundry mats, schools, etc.
18. Advertising
• Daily, weekly, monthly. Newspapers, magazines, multiple radio & TV stations, billboards, rest areas on the major interstates, senior tour bus schedules, Triad Parks & Recreation, W/S Visitors & Tourism Bureau, hand-outs, web-site, coffee mugs, t-shirt give-a-away, etc.
